Hi all. I know there are a lot of posts like this, but I wanted to ask about my specific situation. I understand that the labor bureau is the only place that can give a definitive answer, but I was hoping to hear from people who may have been in a similar position.
I’m a first-year employee at a small Japanese company on a fixed-term contract that ends at the end of next month. The contract requires a three-month notice period. The company already knows that I will not be renewing the contract.
Due to personal reasons, I need to return to my home country by the end of this month, which would mean leaving before the contract ends and also with less than the required three months’ notice.
I’m not sure what to tell my employer. They are generally alright people and our relationship is neutral, but I’m worried they might try to take legal action if I leave at the end of this month. For context, I’m just a staff-level employee, not in a management position.
From what I understand, the general two-week notice rule applies to seishain, and for fixed-term contracts, it only applies after one year, regardless of what the contract says.
If anyone has dealt with something similar or has any advice, I would really appreciate it. Thank you.
