Hello everyone,
I am currently employed by a French company in Japan (in their Japanese branch, which is a Kabushiki Kaisha) since September 2019, under a local contract.
The head office in Paris wants to close this structure on March 31, 2026, and terminate my employment contract on the grounds of economic dismissal (for your information, the company is making huge profits in Japan, even if figures have slightly decreased in recent years).
There are two of us working in this structure, and while they are offering me an economic dismissal because times are tough, they are offering my colleague (with 15 years of seniority) to continue their collaboration through a staffing/umbrella company (asking him, however, to resign in order to sign a new contract with that company).
During my meeting with human resources, the HR director told me that after looking into it, it appears that Japanese law does not provide any severance pay in my case, but that out of their great generosity, they have planned to give me one month’s salary as compensation.
They asked me what I thought about it and what I had in mind; I simply told them that I had no opinion and that I would get back to them.
My question is the following: can I claim more considering my 6 years of seniority? If so, how should I proceed to support my request?
