Does anyone here have experience switching from a Spouse Visa to a Working Visa?
I'm asking for a friend who is planning to get a divorce. They are currently on a Spouse Visa, but a company has already offered to sponsor a working visa (Engineer/Specialist in Humanities category).
For context, she is a college graduate, and the job role matches her degree perfectly. We’re looking for some clarity on the timing:
- The Post-Divorce Window: Once the divorce is finalized, how many months does she realistically have to stay in the country and complete the "Change of Status" process before immigration raises flags?
- Applying Early: Can she apply for the Change of Status before the divorce is finalized? Would it be better to be transparent with Immigration about the pending divorce, or should she wait until the paperwork is officially done?
Any experiences or advice from people who have navigated this "Spouse-to-Work" transition would be greatly appreciated. Thanks!
