So last week i had an accident in Harajuku, where I was driving my friend’s motorbike. I was going straight on a 4 way lane( i am in right lane which is close the center line) and an uber eats driver decided to cross the road out of nowhere from parking on the left to the other side of the road. There is a no U-Turn mark on the road too.
I tried to stop, but it was too sudden and i couldn’t fully stop and we got hit.
We called the police and they noted the accident and took explanations from both of us, and we both told them the same story (that he is doing an illegal crossing and i was going straight).
Now the pain point is, my friend’s motorbike is damaged a bit and he doesn’t have 3rd party coverage insurance. So the uber eats guy’s insurance company called us and asked us to go to any shop and get a “quote “ regarding how much it’s gonna cost for the repair. But since this bike has a paint which is not original from the Yamaha company, the showroom people said they can’t give it. Even if they can, they’re too busy to take non-original parts repairs.
So my question is:
1. Can someone suggest me a place where i can get this repair cost estimate and also get it repaired. I want a place where they also repair these 3rd party body parts issues too.
- The insurance company is arguing that they won’t be able to pay the full fee for the bike as that guy has given indicator and it’s not fully his fault. But since he was crossing the road, the motorcycle body is horizontally alligned to road, so i could not see winker at all.
Should i argue with the insurance company by myself or should I hire a lawyer for this? I am also really scared to drive right now, i want to get that compensation from them too… more like emotional suffering. Since i don’t speak Japanese, can anyone suggest any lawyer who could help me with these cases?
PS: I can’t pay much money for the lawyer by myself. So it would be better if the fee is not too much. Or if they can ensure that i can get more money from their insurance then i can pay higher fee. Point is, I don’t wanna lose any money from my side as i am the victim 🙁

Emotional suffering isn’t awarded for cases where the other party did not willfully try to cause harm.
A japanese traffic insurance case never ends up with 100% blame on one party, unless one of the vehicles was at a complete standstill and out of traffic. It’s almost useless to argue, with or without a lawyer.
The two insurance companies come to an agreement based on a list of check boxes, and assign partial responsibility accordingly. This is unrelated to legal responsibility.
Have you been to the hospital? Go asap ans go many times. I get all the tests too because you could show signs later.
As for the color, how’d and where’d your friend get the color change? Maybe get an estimate from there. It doesn’t matter if theyll be the ones doing the job.
Also, a part of becoming an adult is to own your own stuff and not borrow others in case you damage it and you’ll have to pay twice.
