Home for the Disabled sues former executive for 40 million yen in damages for whistleblowing


TL;DR On Oct. 11, it was learned that Nihon Remake, which operates group homes for people with disabilities, filed a lawsuit seeking about 40 million yen in damages from Tomoyoshi Aoki, a former director of the company, who has blown a whistle on the company overcharging residents, submitting false claims, and possible embezzlement by another director.

Japan’s Whistleblower Protection Act states it is not possible to whistlebrowers, but the company is arguing the former director leaked the information with intent to harm the company and thus should not qualify for the protection.

The prefecture conducted on-site inspections of the homes and instructed the company to return overcharged meal expense and utility costs to the residents.
